When is it necessary or useful to see a child psychologist?

In families, we often do not have the necessary tools to manage events or challenges that occur to us, whether they are specific events such as a move, bereavement or issues such as separation and the new family dynamics that will have to be established after it. In these situations, children may feel lost because they do not have the necessary strategies to face them, being visible in their behavior to the rest of the family and loved ones. Therefore, our job is to provide them with tools to develop effective and age-appropriate coping skills.

In addition, on numerous occasions we encounter difficulties in school performance. We try to identify and address these barriers, allowing children to reach their maximum academic potential, and always looking for what is behind low grades or low performance (emotional blockage, bullying, ADHD, dyslexia…).

In Spain, authorization is required by all persons having parental custody of the minor as established by law (Royal Decree of July 24, 1889 of the Civil Code and Law 41/2002, of November 14), so it will be necessary to review the separation or divorce decree to assess each case individually.

In the event that one of the guardians does not consent to the intervention of a psychologist, the petitioning guardian may appeal through the courts. In this case, a judge will hear both holders of parental authority and the minor if he/she is over 12 years of age. Subsequently, the magistrate will attribute the power to decide to the corresponding guardian, who can make the decision without the consent of the other.

If the minor is 16 years old, he/she could receive psychological care without the authorization of his/her parents, since it is understood that he/she has reached the age of majority in health.

The second paragraph of article 156 of the Civil Code establishes that the consent of both parents will not be necessary when:

  1. There is a condemnatory sentence or an open criminal proceeding against one of the parents for an attempt against the life, physical integrity, freedom, moral integrity or freedom and sexual indemnity of the children.
  2. There is a condemnatory sentence or an open criminal proceeding against one of the parents for attacking the other.
  3. When the woman is receiving assistance in a specialized service of gender violence, even if no complaint has been filed.

If you find yourself in one of the above cases, it will be sufficient to inform the other parent in advance of the start of the psychological care and assistance, without having to seek their consent.

An adequate child therapy requires the involvement of fathers, mothers, siblings and those people close to the children in order to achieve the individual and family welfare that we pursue.

In any case, there is always a fluid communication between therapist and legal guardians, since the feedback on the treatment with the child is fundamental in child psychological intervention.

All minors have the right to be heard, especially in those cases where there is some type of risk for the minor, where the responsibility falls on the legal guardians and not on the professional.

From the age of 14, they may consent to treatment on their behalf, as well as decide to give their legal guardians access to their medical records. Below this age, legal guardians may have access to all the information in your medical record.

From 16 years of age onwards, they can decide on their treatment (except in high-risk situations) and on the switchboard.

Concerning confidentiality, the minor must authorize any information to be communicated to other people, as long as there is no risk to his/her physical and emotional integrity, the integrity of other patients or the integrity of the patient.
